AMENDMENT TO LAND USE BYLAW NO. 1443-10

BYLAW 1640-20

The County of Stettler has prepared Bylaw No. 1640-20 to amend Land Use Bylaw 1443-10. Bylaw No. 1640-20 received first reading from Council at their August 12, 2020 meeting, and is now being circulated for further public review. Bylaw No. 1640-20 proposes to introduce regulations governing the keeping of Urban Chickens within the Country Residence (CR), Country Residence – Small Lot (CR-SL) and Hamlet Residential (HR) Districts of the County of Stettler Land Use Bylaw.


A Public Hearing on the proposed bylaw has been scheduled for September 9, 2020 at 1:00 pm electronically.  The Council Meeting, including the public hearing, will be streamed live at YouTube.com/StettlerCounty. You are welcome to join the live public hearing by teleconference by calling 1-800-309-2350 and entering the conference ID 152-9025 or by submitting written comments via email to cmckenzie@stettlercounty.ca. The hearing will be chaired by the Reeve.  Persons wishing to join by teleconference will be requested to state their name and address for the record upon being recognized by the Chair. Council will hear verbal or written submissions from any person who claims to be affected by the proposed bylaw. Persons may make oral presentations via teleconference at the Council meeting, regardless of whether or not they have provided written comments.

BACKGROUND:

General

Ratepayers requesting to keep chickens on a small scale for personal use have periodically approached the County of Stettler regarding an amendment to the Land Use Bylaw. Currently, the keeping of chickens falls within the definition of an “Agricultural Operation” within the County of Stettler Land Use Bylaw and as such does not allow for the keeping of chickens outside of the Agricultural (A) and Country Residential – Agricultural (CR-A) Districts. The addition of “Urban Chicken” definitions and regulations to the Land Use Bylaw would allow for the expansion of small scale keeping of chickens into the Country Residence (CR), Country Residence – Small Lot (CR-SL) and the Hamlet Residential (HR) districts as well.

Financial

Bylaw 1640-20 requires no financial commitment at this time.

Municipal Government Act Chapter M-26 Revised Statutes of Alberta 2000, Sections 606, 639, 640 and 692.

County of Stettler Land Use Bylaw 1443-10, as amended.

Implementation/Communication

Second and third readings of this Bylaw will be considered following a Public Hearing on September 9, 2020 at 1 PM.
